End User License Agreement

This End User License Agreement (“Agreement”) is between you (“User” or “you”) and Hannes Ulbricht, proprietor of Feldfeste Games Studio (“Developer”, “we”, “us” or “our”), and governs your installation and use of Castellum – Warfare & Cultivation (“Game”).

Please read this Agreement before purchasing, installing or using the Game. If you do not agree to it, do not install or use the Game. This Agreement does not limit any mandatory rights available to you under applicable law.

1. License Grant

Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to install and use legally obtained copies of the Game for your personal, non-commercial entertainment. This is a license to use the Game, not a transfer of ownership. All rights not expressly granted remain reserved.

2. Ownership and Intellectual Property

The Game, including its software, source code, artwork, textures, effects, animations, models, interface, audio, music, dialogue, written content, world design, trademarks, logos and original implementation of gameplay systems, is owned by the Developer or the relevant licensors. Third-party trademarks and other rights remain the property of their respective owners.

4. Mods and User-Generated Content

We welcome community-created maps, scenarios, campaigns, factions, units, cosmetic modifications and compatible Workshop content (“Mods”). You may create and distribute Mods free of charge provided they are lawful, do not infringe third-party rights, contain no malicious software, use only intended modding interfaces and do not compromise anti-cheat systems, security or multiplayer integrity.

Multiplayer Mods may be used only where all participating players have agreed to use compatible modifications. We may restrict Mods that compromise security, online services or fair play. We do not certify third-party Mods, and you use them at your own risk. This does not exclude liability that cannot lawfully be excluded.

Your content

You retain ownership of your original content and confirm that you possess the rights required to upload and distribute it. You must not upload unlawful, infringing, defamatory or malicious content.

License needed to operate community services

When you submit content through the Game, Steam Workshop or an official Developer service, you grant us a worldwide, non-exclusive, royalty-free and sublicensable license to host, reproduce, display, distribute, technically modify, archive and promote that content only as reasonably necessary to operate, secure, promote and continue developing the Game and its community services.

This license ends when the content is permanently removed from all relevant services, except where continued retention is required by law, for security, backup or evidentiary purposes, or where the content has already been used in promotional material or incorporated into the Game with your permission. Applicable platform terms, including Steam Workshop terms, remain unaffected.

5. Save Games and Replays

Save and replay files may be stored locally or through third-party cloud services. You should maintain appropriate backups. Because the Game is under active development, files may become incompatible after updates. We do not guarantee compatibility between all Game versions.

You may save, share, analyse and broadcast replay files for lawful educational, tournament and community purposes, subject to the intellectual-property rights in the Game and the rights of other players.

6. Online Services

Some features may require internet access, Steam, a valid platform account, matchmaking, cloud saves, achievements, dedicated servers or peer-to-peer networking. Third-party services are governed by their own terms and may be unavailable for reasons outside our control.

We may maintain, secure, modify or discontinue online features for valid technical, security, legal, balancing, capacity or operational reasons. Where required by applicable law, material changes will be communicated clearly and in advance on a durable medium, without additional cost, and any statutory right to retain an unchanged version or terminate the relevant contract remains unaffected.

7. Fair Play and Competitive Integrity

In online play you must not cheat, hack, intentionally exploit defects, use bots or automation, manipulate network traffic, interfere with anti-cheat systems, impersonate others, harass users, distribute malware or deliberately disrupt matches.

We may use proportionate technical measures to investigate suspected violations. Depending on the seriousness and frequency of a violation, we may issue a warning, restrict features, suspend access, remove leaderboard entries or impose a multiplayer ban. Except in urgent or serious cases, we will use a proportionate response and provide a reasonable means to contact us regarding an apparent error. Mandatory refund and consumer rights remain unaffected.

8. Artificial Intelligence and Automation

You may not use artificial intelligence, machine-learning systems, automated decision tools or similar technology to control gameplay, replace player input, automate strategic decisions or gain an unfair competitive advantage over human players. This does not prohibit accessibility technology or assistive software required or protected by applicable law.

9. Streaming, Videos and Content Creation

You may livestream gameplay, publish screenshots, tutorials and reviews, and monetise gameplay videos on platforms such as YouTube or Twitch, provided you use a legitimate copy, respect applicable law and platform rules, and do not unlawfully include third-party material.

We may revoke this permission for specific content where reasonably necessary because it is unlawful, infringes rights, discloses confidential pre-release material or falsely claims an official partnership or endorsement. Honest criticism, negative reviews and lawful commentary are expressly permitted.

10. Early Access

The Game may be released in Early Access and can contain bugs, unfinished features, placeholders, balance issues, performance problems and incomplete localisation. Features, artwork, systems, networking and compatibility may evolve during development. Development plans and announced features are goals, not guarantees, unless expressly agreed otherwise.

11. Updates and Changes

We may provide patches, hotfixes, balance changes, additional content, security improvements and other updates. Certain updates may be necessary to maintain conformity, security or access to online services. We will provide and communicate required updates for the period required by applicable law.

Changes beyond those necessary to maintain conformity will be made only for a valid reason, such as adaptation to a changed technical environment, security, legal requirements, service capacity, balancing or continued development. They will not impose additional costs. Where a change materially impairs access or use, statutory information and termination rights remain unaffected.

12. Third-Party Software and Services

The Game may use third-party software, middleware, libraries and services. Those components remain subject to their applicable licenses. Open-source licenses continue to apply to their respective components and take precedence where required.

13. Privacy

Online functionality may process limited technical and account-related data, including session and matchmaking information, achievements, cloud synchronisation, crash and diagnostic information, Game version, device information and security-related data where applicable.

Personal data will be processed in accordance with applicable data-protection law. A separate Privacy Policy identifying the controller, purposes, legal bases, recipients, retention periods, international transfers and your rights will be made available wherever personal data is collected. Platform providers such as Steam process data under their own privacy terms.

14. Historical and Political Disclaimer

The Game is a fictional work inspired by history. It may combine researched material with fictional characters, places, events, political situations, organisations and mechanics. It is not presented as an academically exact reconstruction.

Historical governments, social structures, conflicts and institutions are depicted for entertainment, education and gameplay. The Developer does not endorse extremism, discrimination, unlawful conduct or any political ideology.

15. Feedback

If you voluntarily submit ideas, suggestions, bug reports or balancing proposals, you grant us a perpetual, worldwide, non-exclusive, royalty-free and irrevocable right to use, adapt and incorporate that feedback into the Game or other products without compensation or attribution. This does not transfer ownership of complete original creative works submitted under separate terms.

16. Statutory Rights and Warranty

Nothing in this Agreement excludes or limits mandatory statutory rights, including rights concerning the supply and conformity of digital products, required updates, cure, price reduction, termination or refunds.

To the extent permitted by law and only beyond those mandatory rights, the Game is provided “as is” and “as available”. We do not promise uninterrupted or error-free operation, permanent availability of third-party services, or compatibility with every hardware and software configuration.

17. Liability

We are liable without limitation for intent and gross negligence; for injury to life, body or health caused intentionally or negligently; under mandatory product-liability law; for fraudulently concealed defects; and where we have expressly assumed a guarantee.

For slight negligence, we are liable only for breach of an essential contractual obligation whose fulfilment enables proper performance of the Agreement and on which you may ordinarily rely. In that case, liability is limited to the foreseeable damage typical for this type of agreement. These limitations also apply to our representatives and agents. Liability that cannot legally be limited remains unaffected.

18. Export Restrictions

You must not export, re-export or transfer the Game in violation of applicable export-control laws or economic sanctions. You are responsible for applicable import and export requirements in your jurisdiction.

19. Suspension and Termination

This Agreement remains effective until terminated. We may suspend affected features or terminate the license for a material or repeated breach. Where reasonable, we will first notify you and provide an opportunity to remedy the breach. Immediate action may be taken where necessary to protect users, services, security or legal compliance.

Following valid termination, your license ends and affected online access may be disabled. Provisions intended by their nature to survive—including intellectual-property provisions and lawful limitations of liability—remain effective. Mandatory rights, remedies and refunds remain unaffected.

20. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing outside Germany, this choice does not deprive you of mandatory protections available under the law of your habitual residence.

21. Severability and Entire Agreement

If a provision is invalid or unenforceable, the remaining provisions remain effective. The applicable statutory rule takes the place of an invalid standard term. This Agreement and any expressly incorporated platform-specific terms constitute the agreement concerning use of the Game. Individual agreements take precedence.
